1. About these terms

These terms apply to your use of the Penny Pulse app for Android and the website at pennypulse.co.in, provided by Penny Pulse ("we", "us"). By installing or using the app, you agree to these terms. If you don't agree, please don't use the app.

How the app handles your information is explained in our Privacy Policy, which forms part of these terms.

2. What Penny Pulse is

Penny Pulse is a personal finance app that helps you record your income and spending, plan budgets and track your progress. It is free to use. Everything you enter is stored on your phone, and the app does not connect to your bank accounts.

You must be 18 or older to use Penny Pulse.

3. Not financial advice

Penny Pulse is a tracking tool. Figures it shows, such as balances, budgets, forecasts and "safe to spend" amounts, are calculated only from what you enter and are estimates. They are not financial, tax, investment or legal advice, and they are not a statement from any bank. Please make your own decisions, and talk to a qualified professional where you need advice.

4. Your data and your passphrase

• You are responsible for what you enter in the app and for keeping your phone secure.
• Because your data is stored on your phone, it can be lost if your phone is lost, reset or damaged, or if the app is uninstalled. Optional Google Drive backup and export from Settings can help protect against this.
• If you turn on backup, you choose a backup passphrase. We never see it and cannot reset or recover it. If you forget it, your backups cannot be restored. Keep it somewhere safe.
• If you use Google Drive backup, your use of Google's services is also governed by Google's own terms.

5. Acceptable use

Please use Penny Pulse only for lawful, personal purposes. Don't:

• use the app to break any law, or to record or plan unlawful activity;
• copy, modify, resell or redistribute the app, or remove its notices;
• reverse engineer the app, or try to get around its security features, except where the law allows you to;
• misuse our website or contact address, for example by sending spam or malware.

The Penny Pulse name, logo and app are ours. Using the app gives you a personal, non-transferable right to use it, not ownership of it.

6. No warranty

We work hard to make Penny Pulse reliable, but it is provided "as is" and "as available", without warranties of any kind, whether express or implied, including that it will be error-free, uninterrupted or fit for a particular purpose. We may change, suspend or stop offering the app or any feature at any time.

7. Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental or consequential loss, or for any loss of data, money or profit, arising from your use of, or inability to use, Penny Pulse. This includes decisions you make based on figures shown in the app, and data that cannot be restored because a backup passphrase was lost.

Because the app is free, our total liability to you for any claim is limited to ₹1,000 (one thousand Indian rupees). Nothing in these terms limits any liability that cannot be limited under applicable law.

8. Changes to these terms

We may update these terms from time to time. When we do, we will change the date at the top of this page, and for significant changes we will tell you in the app. If you keep using Penny Pulse after an update, the updated terms apply. If you don't agree with them, you can stop using the app and delete your data at any time.

9. Governing law

These terms are governed by the laws of India. The courts of Bengaluru, Karnataka have exclusive jurisdiction over any dispute arising from them or from your use of Penny Pulse.
